01Acceptance of terms
By installing or using Surfcast (the "App") or visiting surfcastapp.com (the "Site"), you confirm that you accept these Terms of Use and agree to comply with them. If you do not agree, you must not use the App or the Site.
You must be at least 13 years old, or the minimum age of digital consent in your country, to use Surfcast. If you are under the age of majority where you live, you should review these terms with a parent or guardian.
02The service
Surfcast provides surf and marine weather forecasts, including wave height, swell period and direction, wind, tide and related data for surf spots worldwide. The App is currently distributed through the Apple App Store and may be offered free of charge or with optional paid features.
We may add, change, suspend or remove features at any time. We may also limit the availability of the service in certain regions or to certain users at our discretion.
03Forecast data & safety
Surfcast aggregates forecasts produced by global numerical weather and wave models operated by third parties. Forecasts are predictions, not guarantees. Actual ocean conditions can differ significantly from any forecast and can change rapidly.
- Never rely on Surfcast as your sole source of information before entering the water.
- Surfing and ocean activities carry inherent risks, including serious injury and death.
- Always assess conditions in person, heed local warnings and lifeguards, and surf within your ability.
You are solely responsible for decisions you make based on information in the App.
04Acceptable use
You agree not to misuse the App or Site. In particular, you must not:
- Copy, scrape, resell or redistribute forecast data or other content except as expressly permitted.
- Reverse engineer, decompile or attempt to extract the source code of the App, except where permitted by law.
- Interfere with, disrupt or place undue load on our systems or networks.
- Use the service for any unlawful purpose or in violation of any applicable regulation.
05Intellectual property
The App, the Site, the Surfcast name and logo, and all associated design, text and software are owned by Surfcast or its licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use the App for your own non-commercial purposes, subject to these terms.
06Third-party data & services
Forecast and map data is sourced from third parties, which may include national and international meteorological services and mapping providers. Their data is subject to their own terms and licences. We are not responsible for the accuracy, availability or content of any third-party data or service, and references to them do not imply endorsement.
07Disclaimer of warranties
The App and Site are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the service will be uninterrupted, error-free, secure, or that any forecast will be accurate.
08Limitation of liability
To the fullest extent permitted by law, Surfcast and its team will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, goodwill or other intangible losses, arising out of or relating to your use of — or inability to use — the App or Site, including any reliance on forecast data.
Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence.
09Changes to these terms
We may update these Terms of Use from time to time. When we make material changes, we will revise the "last updated" date above and, where appropriate, provide an in-app notice. Your continued use of the App after changes take effect constitutes acceptance of the revised terms.
